TERMS AND CONDITIONS OF USE OF THE arielaz.com SITE (HEREINAFTER THE “STORE” OR THE “SITE”) EFFECTIVE AS OF TUESDAY, NOVEMBER 6, 2021.

PRELIMINARY CONSIDERATIONS

This contract describes the general terms and conditions (hereinafter the "GTC") applicable to the use of the services offered by Ariela Zaidman Saed (hereinafter the "Company") within the arielaz.com Store. Both the website and the Company will be jointly identified as “arielaz.com”. Any person who wishes to access and/or use arielaz.com or the Services (the “User”) may do so subject to the GTC, together with all other policies and principles that govern arielaz.com and which are incorporated herein by reference.

ANYONE WHO DOES NOT ACCEPT THESE GENERAL TERMS AND CONDITIONS, WHICH ARE MANDATORY AND BINDING, SHOULD REFRAIN FROM USING arielaz.com AND/OR THE SERVICES.

The User must read, understand and accept all the conditions established in the TCG and in the Privacy Notice as well as in the other documents incorporated therein by reference, prior to registering as a User on arielaz.com.

CLAUSES

FIRST.- ACCEPTANCE OF LEGAL TERMS.
With the aim of offering a safe and pleasant environment for our Users, we have established rules and terms under which the areas of responsibility and rights of both arielaz.com and our users are delimited.

By visiting arielaz.com the User is subject to the guidelines, rights and restrictions mentioned here. arielaz.com reserves the right to modify this document at the time and under the circumstances that best suit it, these changes being effective at the time of publication.

SECOND.- REGISTRATIONS, ACCOUNTS, PASSWORDS AND SECURITY.
arielaz.com will use the information provided by the User in a confidential manner, so it will not be able to disseminate or transmit it to other suppliers unrelated to the transaction, unless expressly authorized by the User himself or at the request of some competent authority.

The use of arielaz.com may require the User to open an account and establish a password. The User is entirely responsible for maintaining the secrecy of his or her account information, including his or her password, for any and all activity that occurs under his or her account. The User agrees to notify arielaz.com immediately of any unauthorized use of their account or password, or any other risk to the security of their account.

The data that the User enters must be completely true, if they are erroneous or false, arielaz.com reserves the right to delete the account registered with that data and prohibit the registration of said person identified by email, name or any other other than arielaz.com deems appropriate.

THIRD.- PAYMENT FORMS.
Directly on our portal through Paypal with Visa, Master Card or American Express credit cards or debit cards from most Mexican banks.

FOURTH.- PAYMENT AND MERCHANDISE POLICIES.
arielaz.com reserves the right to request official documents from its clients, as a means of validation of the product acquisition process through its website.

The order number assigned when making the transaction on the arielaz.com website does not imply acceptance of the transaction. If you have any problem with the User's order, arielaz.com will inform you of this situation by email or telephone.

Notifications of your purchase, shipping, delivery and others will be made through email or through the arielaz.com website.

FIFTH.- AVAILABILITY OF MERCHANDISE AND STOCK.
All products offered on arielaz.com are made to order and have a production time of 4-6 weeks and even longer in high season. This will be the time the user will wait unless they purchase from the "IMMEDIATE DELIVERY" section.

SIXTH.- PRICES.
The prices published on the arielaz.com website may change without prior notice. If for any reason the price is $0.00 or $0.01 or something else that is clearly erroneous, the User must contact info@arielaz.com via email in order to request the correct price of the desired item.

SEVENTH.- PRODUCT SPECIFICATIONS.
Product features and specifications may change without prior notice. The photographs may or may not correspond specifically to these, being of a similar product represented for illustrative purposes only.

EIGHTH.- SHIPPING OF PRODUCTS.
Delivery time begins once the parcel guide is received. Parcel companies are external to arielaz.com and have their own external delivery time.

The products will be sent by parcel or private courier to the User's home and/or any office of said parcel or courier, the delivery time will depend on the service chosen at the time of making the purchase. Once payment is confirmed and accepted, the User accepts that arielaz.com may delay delivery without a defined time if the product is out of stock or any event occurs that prevents delivery on the selected days.

NINTH.- PACKAGING.
All merchandise will be packaged at no charge to the customer, except for high volume products.

TENTH.- CANCELLATIONS.
The cancellation of the order only applies before arielaz.com confirms the shipment of the order. Once the order is canceled, a refund process will begin, within which the User must send the bank details to which the refund must be made, including: name of the bank, name of the owner, account number and CLABE of the account (18 digits). The refund will be made specifically through the same payment method or method that the user used to make the corresponding purchase.

ELEVENTH.- DATA PROTECTION.
The data provided by the User will be protected according to our privacy notice, published on arielaz.com.

TWELFTH.- PRODUCT WARRANTY.

arielaz.com offers a 1-year warranty on its products at no cost to the customer, as long as they are production defects.

If the User misuses the part and it is damaged, they may contact us for repair with an additional cost for the User that will be determined by contacting the arielaz.com production team.

THIRTEENTH.- BILLING.
In the event that the User requires an invoice for the total amount of their purchases and does not request it when entering arielaz.com, they may request it by email info@arielaz.com, sending for such purposes their order number, name or company name. , RFC and complete tax address. The data must be sent within the current month and year, at least 5 days prior to the end of the current calendar month.

Invoices cannot be issued for purchases made outside of the current month.

FOURTEENTH.- RETURN POLICY.
The User may request the exchange of their products or the refund of their payment when the products in question are not in the conditions described and this is done within the first 20 (twenty) days of receiving their order.

FIFTEENTH.- APPLICABLE LAW AND JURISDICTION.
For the interpretation and compliance of these terms and conditions, the parties submit to the jurisdiction of the courts of Mexico City, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles.

SIXTEENTH.- NOTIFICATIONS

Notifications will be valid at the email address info@arielaz.com and will be presumed received no later than five business days after being sent.
